Remember, a will is not effective until the death of the testator and the will is presented in Surrogate Court and is probated. That is accomplished by preparing a probate petition for the executor and presenting it to the court with the will and proof that the required relatives are on notice. Upon admitting the will to probate the terms of the will can be enforced and the executor is given the power to execute the terms of the will. This office assists the executor along the way through the final distribution of the assets of the estate as required by the will.
